Acceptance of Terms

By accessing our website, using our services, or becoming a member of AnchorGjox, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our services. These terms constitute a legally binding agreement between you and AnchorGjox B.V.

About Our Services

AnchorGjox provides specialized fitness and wellness services designed for adults aged 50 and above. Our services include:

• Strength training programs
• Balance and mobility classes
• Cardiovascular health programs
• Flexibility and wellness sessions
• Personal training services
• Nutritional guidance and wellness workshops

Membership and Registration

To access our services, you must register for membership and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

• You must be at least 18 years old to enter into this agreement
• You must provide accurate health information and medical clearances as required
• You agree to notify us of any changes to your health status or contact information
• Membership is personal and non-transferable

Health and Safety Requirements

Your health and safety are our top priorities. By using our services, you acknowledge and agree that:

• You have consulted with your physician before beginning any exercise program
• You will inform us of any health conditions, injuries, or limitations that may affect your participation
• You will follow all safety guidelines and instructions provided by our staff
• You understand that physical exercise involves inherent risks
• You will use equipment properly and report any defects or safety concerns immediately

Payment Terms and Fees

Membership fees and payment terms are as follows:

• Monthly membership fees are due in advance on the same date each month
• Payment must be made via the agreed method (bank transfer, direct debit, etc.)
• Late payment may result in suspension of services
• All fees are in Euros (EUR) and include applicable VAT
• Fee changes will be communicated with 30 days' notice

Cancellation and Refunds

Membership cancellation and refund policies:

• You may cancel your membership with 30 days' written notice
• Cancellation must be submitted in writing to contact@anchorgjox.top
• No refunds for partial months unless required by law
• Medical cancellations may be eligible for prorated refunds with doctor's documentation
• Prepaid fees for future services will be refunded upon cancellation

Code of Conduct

All members must adhere to our code of conduct:

• Treat all staff and members with respect and courtesy
• Follow all facility rules and posted guidelines
• Maintain appropriate hygiene and dress code
• Report any accidents or incidents immediately to staff
• Refrain from disruptive, inappropriate, or unsafe behavior
• Respect others' privacy and personal space

Intellectual Property

All content on our website and in our programs, including text, graphics, logos, images, videos, and software, is the property of AnchorGjox or our licensors and is protected by Dutch and international copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

Privacy and Data Protection

We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection laws. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Limitation of Liability

To the fullest extent permitted by Dutch law, AnchorGjox's liability for any claims arising from your use of our services is limited to the amount you paid for membership in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless AnchorGjox, its directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Force Majeure

AnchorGjox is not liable for any failure to perform its obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or other force majeure events. In such cases, we will make reasonable efforts to resume services and may offer alternative arrangements or membership extensions.

Termination

We reserve the right to terminate or suspend your membership immediately, without prior notice, for any breach of these Terms, including but not limited to:

• Violation of safety rules or code of conduct
• Non-payment of fees
• Providing false information during registration
• Behavior that endangers the safety or well-being of others

Upon termination, your right to use our services ceases immediately, and you must return any AnchorGjox property in your possession.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website at least 30 days before they take effect. Your continued use of our services after the effective date constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of The Hague, Netherlands.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and AnchorGjox regarding your use of our services and supersede all prior agreements and understandings.
